Dans cette perspective, plusieurs l\u00e9gislations africaines, inspir\u00e9es du droit fran\u00e7ais, consacrent le principe de la continuit\u00e9 des contrats de travail en cas de modification de la situation juridique de l\u2019employeur. Si ce m\u00e9canisme vise \u00e0 garantir la stabilit\u00e9 de l\u2019emploi et la protection des travailleurs, sa port\u00e9e demeure relative en raison des possibilit\u00e9s de restructuration reconnues \u00e0 l\u2019employeur. \u00c0 partir d\u2019une approche doctrinale et comparative, cette \u00e9tude examine les fondements, les justifications et les limites de ce principe dans les syst\u00e8mes juridiques africains. Elle met en lumi\u00e8re les tensions qui peuvent exister entre les objectifs de protection des travailleurs et les contraintes \u00e9conomiques auxquelles les entreprises sont confront\u00e9es. L\u2019analyse d\u00e9bouche sur des propositions visant \u00e0 renforcer l\u2019effectivit\u00e9 de la protection des salari\u00e9s dans les situations de transfert d\u2019entreprise.<\/p>\n<p>Mots-cl\u00e9s : continuit\u00e9 ; contrats ; travail ; transfert ; entreprise.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>Abstract<\/strong><\/span><br \/>\nLabor law has historically aimed to protect employees because of their legal and economic subordination in the employment relationship. From this perspective, several African laws, inspired by French law, uphold the principle of continuity of employment contracts in case of changes in the employer&rsquo;s legal situation or business transfer. While this mechanism is meant to ensure job stability and protect workers, its reach remains limited due to the restructuring options available to employers. Using a doctrinal and comparative approach, this study looks at the foundations, justifications, and limits of this principle in African legal systems. It highlights the tensions that can exist between worker protection goals and the economic constraints companies face.
